Welcome to ElecSys Lab. By accessing our website (the “Site”), purchasing products, or engaging in our services, you agree to comply with and be bound by these Terms of Service ("Terms").

These Terms apply to all visitors, customers, merchants, and users of the Site.

If you do not agree to these Terms, you must not access our website, purchase our products, or engage with our services.

By using the Site or engaging in transactions with ElecSys Lab, you accept these Terms, including additional terms referenced herein or provided during transactions.

SECTION 2 - PRODUCTS AND ONLINE STORE TERMS

We strive to ensure accuracy in product descriptions, but we do not warrant that product details, images, or specifications are error-free or up to date.

 

Pricing:
All prices are subject to change without notice. Prices displayed on the Site are final at the time of purchase.

 

Availability:
Products may have limited quantities and are subject to return or exchange only as outlined in our Return Policy.

 

Order Acceptance:
We reserve the right to limit or refuse orders, including those placed by individuals, resellers, or distributors. Orders are confirmed only upon payment and acknowledgment by us.

Shipping timelines are estimates and may vary. We are not liable for delays caused by third-party carriers or unforeseen circumstances.

 

SECTION 3 - WARRANTY TERMS

 

Standard Warranty:


a. Warranty applies only to products sold directly by ElecSys Lab and covers manufacturing defects under normal use conditions.
b. Warranty claims require the product to be returned to our office or factory at the customer’s expense.
c. Repairs or replacements under warranty are limited to the product itself and do not include related components, systems, or labor.

 

Exclusions:


a. Warranty does not cover:

Damage caused by misuse, neglect, or unauthorized modifications.

Third-party products, integrations, or components.

Onsite inspections, troubleshooting, or configuration services.
b. Onsite services, premium support, and expedited repairs are not covered under warranty and are chargeable separately.

 

Customer Responsibility:


Customers must follow installation, operation, and maintenance guidelines provided with the product. Failure to do so voids the warranty.

 

SECTION 4 - SERVICES AND ONSITE TERMS

 

Premium Services:


a. Onsite inspections, troubleshooting, recommendations, and configurations are premium services provided on a fee-for-service basis.
b. These services must be agreed to in writing before commencement and are not refundable.

 

Scope of Responsibility:


a. Onsite services do not guarantee resolution of system issues.
b. ElecSys Lab is not liable for:

 

Third-party systems or components.

Business interruptions or downtime during service.

Loss or damage incurred due to the customer’s failure to disclose relevant details.

 

Alternative Options:


Customers always have the option to return products to our office for evaluation or repairs under standard warranty terms.

 

SECTION 5 - PAYMENTS AND COLLECTION

 

Payment Terms:


a. All invoices are due for payment within the terms specified or, if unspecified, within 14 days of issuance.
b. Failure to pay constitutes a breach of contract and may result in service suspension or legal escalation.

 

Late Payments:


a. Overdue invoices will incur interest at a rate of 2.5% per month, compounded monthly.
b. Collection fees, legal expenses, and administrative costs will be added to unpaid balances.

 

Disputed Charges:


a. Disputes regarding charges must be raised in writing within 7 days of receipt. Failure to dispute within this period constitutes acceptance.
b. Disputes do not absolve the customer of paying undisputed amounts.

 

SECTION 6 - RETURNS AND REFUNDS

 

Product Returns:


a. Returns are accepted within 14 days of receipt for unused products in original packaging, subject to inspection.
b. Custom products or services are non-refundable.

 

Service Refunds:


a. Onsite services, premium support, and expedited repairs are non-refundable once rendered.
b. Refunds will not be issued for delays caused by third parties or external factors beyond our control.

 

SECTION 7 - LIMITATION OF LIABILITY

 

To the fullest extent permitted by law:

 

No Warranties: Services and products are provided "as is" and "as available," with no warranties beyond those explicitly stated.

Liability Cap: Our liability for claims is limited to the amount paid for the product or service in question.

Exclusion of Damages: We are not liable for indirect, incidental, or consequential damages, including lost revenue, business interruptions, or third-party claims.

 

SECTION 8 - INTELLECTUAL PROPERTY

 

Ownership: All content, designs, and materials on the Site are owned by ElecSys Lab and protected by intellectual property laws.

Prohibited Use: Users may not reproduce, modify, or distribute our intellectual property without express written consent.

 

SECTION 9 - GOVERNING LAW AND DISPUTES

 

Jurisdiction: These Terms are governed by New Zealand law.

Dispute Resolution:
a. Disputes will be resolved through the Disputes Tribunal of New Zealand or a competent legal forum.
b. The prevailing party is entitled to recover reasonable legal fees and associated costs.

 

SECTION 10 - FORCE MAJEURE

 

We are not liable for delays or failures caused by circumstances beyond our control, including but not limited to natural disasters, pandemics, or government actions.

 

SECTION 11 - CUSTOMER RESPONSIBILITIES

 

Customers are responsible for:


a. Providing accurate information for billing, shipping, and service requests.
b. Ensuring third-party systems and integrations are operational and compatible.
c. Disclosing relevant details about system issues before requesting services.

 

SECTION 12 - CHANGES TO TERMS

 

We reserve the right to update these Terms at any time. It is the customer’s responsibility to review them periodically. Continued use of our Site or services constitutes acceptance of any changes.
